Can USA green card holder fly from Toronto to India? What about my exit record at USA airport?
Hello all. My parents got USA green card last year and came to Toronto. After 5 month they are flying from Toronto to India. I am worried about their USA status as they wanted to come back after one year. Do they have to inform about their departure and hopefully when they reentre after one year they won’t get any questions at the USA airport …any one please.
Correct. They need to get a re-entry permit BEFORE they leave the US otherwise they might lose their green cards at the airport if the return more than one year later. Note that the re-entry permit is valid for absence of up to two years. After two years, they would lose their green cards anyway. Also, they will need to file taxes etc. while they are away. They will need to file form I-131.
Your parents will need to come back to the US for processing of the I-131.
